PREAMBLE

WE THE PEOPLES OF THE UNITED NATIONS DETERMINED

  • to save succeeding generations from the scourge of war, which twice in our lifetime has brought untold sorrow to mankind, and
  • to reaffirm faith in fundamental human rights, in the dignity and worth of the human person, in the equal rights of men and women and of nations large and small, and
  • to establish conditions under which justice and respect for the obligations arising from treaties and other sources of international law can be maintained, and
  • to promote social progress and better standards of life in larger freedom,

AND FOR THESE ENDS

  • to practice tolerance and live together in peace with one another as good neighbours, and
  • to unite our strength to maintain international peace and security, and
  • to ensure, by the acceptance of principles and the institution of methods, that armed force shall not be used, save in the common interest, and
  • to employ international machinery for the promotion of the economic and social advancement of all peoples,

HAVE RESOLVED TO COMBINE OUR EFFORTS TO ACCOMPLISH THESE AIMS

Accordingly, our respective Governments, through representatives assembled in the city of San Francisco, who have exhibited their full powers found to be in good and due form, have agreed to the present Charter of the United Nations and do hereby establish an international organization to be known as the United Nations.

منشور ملل متحد ما مردم ملل متحد با تصمیم به محفوظ داشتن نسلهای آینده از بلای جنگ که دوبار در مدت یک عمر انسانی افراد بشر را دچار مصائب غیر قابل بیان نموده و با اعلام مجدد ایمان خود به حقوق اساسی بشر و به حیثیت و ارزش شخصیت انسانی و به تساوی حقوق مرد و زن و همچنین بین ملت‌ها اعم از کوچک و بزرگ و ایجاد شرایط لازم برای حفظ عداتل و احترام الزامات ناشی از عهد‌نامه‌ها و سایر منابع حقوق بین‌المللی و کمک به ترقی اجتماعی و شرایط زندگی بهتر با آزادی بیشتر،و برای نیل به این هدفها به رفق و مدارا کردن و زیستن در حال صلح با یکدیگر با یک روحیه حسن همجواری و به متحد ساختن قوای خود برای نگاهداری صلح و امنیت بین‌المللی و به قبول اصول و ایجاد روشهایی که عدم استفاده از نیروهای مسلح را جز در راه منافع مشترک تضمین نماید و به توسل به وسائل و مجاری بین‌المللی برای پیشبرد ترقی اقتصادی و اجتماعی تمام ملل مصمم شده‌ایم که برای تحقق این مقاصد تشریک مساعی نمایی.

و در نتیجه دولت‌های متبوع ما توسط نمایندگان خود که در شهر سانفرانسیسکو گرد آمده‌اند و اختیارات تامه آنان ابراز و صحت و اعتبار آن محرز شناخته شده است نسبت به این منشور ملل متحد موافقت حاصل نموده‌اند و بدینوسیله یک سازمان بین‌المللی که موسوم به ملل متحد خواهد بود تاسیس می‌نمایند.

CHAPTER I: PURPOSES AND PRINCIPLES

The Purposes of the United Nations are:

  1. To maintain international peace and security, and to that end: to take effective collective measures for the prevention and removal of threats to the peace, and for the suppression of acts of aggression or other breaches of the peace, and to bring about by peaceful means, and in conformity with the principles of justice and international law, adjustment or settlement of international disputes or situations which might lead to a breach of the peace;
  2. To develop friendly relations among nations based on respect for the principle of equal rights and self-determination of peoples, and to take other appropriate measures to strengthen universal peace;
  3. To achieve international co-operation in solving international problems of an economic, social, cultural, or humanitarian character, and in promoting and encouraging respect for human rights and for fundamental freedoms for all without distinction as to race, sex, language, or religion; and
  4. To be a centre for harmonizing the actions of nations in the attainment of these common ends.

فصل اول – مقاصد و اصول


ماده ۱ مقاصد ملل متحد به قرار زیر است: ۱- حفظ صلح و امنیت بین‌المللی و بدین منظور به عمل آوردن اقدامات دسته جمعی موثر برای جلوگیری و برطرف کردن تهدیدات علیه صلح و متوقف ساختن هرگونه عمل تجاوز یا سایر کارهای ناقض صلح و فراهم آوردن موجبات تعدیل و حل و فصل اختلافات بین‌المللی یا وضعیت‌هایی که ممکن است منجر به نقض صلح گردد با شیوه‌های مسالمت‌آمیز و برطبق اصول عدالت و حقوق بین‌الملل:

۲- توسعه روابط دوستانه در بین ملل بر مبنای احترام به اصل تساوی حقوق و خود مختاری ملل و انجام سایر اقدامات مقتضی برای تحکیم صلح جهانی؛

۳- حصول همکاری بین‌المللی در حل مسائل بین‌المللی که دارای جنبه‌های اقتصادی و اجتماعی و فرهنگی یا بشردوستی است و در پیشبرد و تشویق احترام به حقوق بشر و آزادیهای اساسی برای همگان بدون تمایز از حیث ن.اد – جنس – زبان یا مذهب؛ و

۴- بودن مرکزی برای هماهنگ کردن اقداماتی که ملل جهت حصول این هدفهای مشترک معمول می‌دارند.

 

Article 2

The Organization and its Members, in pursuit of the Purposes stated in Article 1, shall act in accordance with the following Principles.

  1. The Organization is based on the principle of the sovereign equality of all its Members.
  2. All Members, in order to ensure to all of them the rights and benefits resulting from membership, shall fulfill in good faith the obligations assumed by them in accordance with the present Charter.
  3. All Members shall settle their international disputes by peaceful means in such a manner that international peace and security, and justice, are not endangered.
  4. All Members shall refrain in their international relations from the threat or use of force against the territorial integrity or political independence of any state, or in any other manner inconsistent with the Purposes of the United Nations.
  5. All Members shall give the United Nations every assistance in any action it takes in accordance with the present Charter, and shall refrain from giving assistance to any state against which the United Nations is taking preventive or enforcement action.
  6. The Organization shall ensure that states which are not Members of the United Nations act in accordance with these Principles so far as may be necessary for the maintenance of international peace and security.
  7. Nothing contained in the present Charter shall authorize the United Nations to intervene in matters which are essentially within the domestic jurisdiction of any state or shall require the Members to submit such matters to settlement under the present Charter; but this principle shall not prejudice the application of enforcement measures under Chapter Vll.

ماده ۲- سازمان و اعضای آن در تعقیب مقاصد مذکور در ماده اول بر طبق اصول زیر عمل خواهند کرد:

۱- سازمان برمبنای اصل تساوی حاکمیت کلیه اعضاء آن قرار دارد.

۲- کلیه اعضاء به منظور تضمین حقوق و مزایای ناشی از عضویت تعهداتی را که به موجب این منشور بر عهده گرفته‌اند با حسن نیت انجام خواهند داد.

۳- کلیه اعضاء اختلافات بین‌المللی خود را به وسایل مسالمت‌آمیز به طریقی که صلح و امنیت بین‌المللی و عدالت به خطر نیافتد، حل خواهند کرد.

۴- کلیه اعضاء در روابط بین‌المللی خود از تهدید به زور یا استفاده از آن علیه تمامیت ارضی یا استقلال سیاسی هر کشوری یا از هر روش دیگری که با مقاصد ملل متحد مباینت داشته باشد خودداری خواهند نمود.

۵- کلیه اعضاء در هر اقدامی که سازمان برطبق این منشور به عمل آورد به سازمان همه گونه مساعدت خواهند کرد و از کمک به هر کشوری که سازمان ملل متحد علیه آن اقدام احتیاطی یا قهری به عمل می‌آورد خودداری خواهند نمود.

۶- سازمان مراقبت خواهد کرد کشورهایی که عضو ملل متحد نیستند تا آنجا که برای حفظ صلح و امنیت بین‌المللی ضروری است بر طبق این اصول عمل نمایند.

۷- هیچیک از مقررات مندرج در این منشور، ملل متحد را مجاز نمی‌دارد در اموری که ذاتاً جزو صلاحیت داخلی هر کشوری است دخالت نماید و اعضاء را نیز ملزم نمی‌کند که چنین موضوعاتی را تابع مقررات این منشور قرار دهند لیکن این اصل به اعمال اقدامات قهری پیش‌بینی شده در فصل هفتم لطمه وارد نخواهد آورد.
